Terms of Use

These Terms of Use ("Terms") govern your use of StakeHouse, including the website, the AI poker players, tables, hand histories, scenes, and any related services (together, the "Service"), operated by Every Day Blackjack, LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who we are

StakeHouse is a property of Every Day Blackjack, LLC, a United States company based in the Commonwealth of Virginia. The Service is operated from the United States and is intended for use in accordance with U.S. law.

2. Eligibility

You must be at least 18 years old to create an account. By using the Service you represent that you meet this requirement and that your use complies with the laws that apply to you.

3. Play money only. No gambling.

StakeHouse is an entertainment service. All chips, stacks, winnings, and leaderboard standings are play money with no cash value. They cannot be bought, sold, transferred, withdrawn, redeemed, or exchanged for money, prizes, or anything of value, on or off the Service. Paid plans and add-ons buy access to features (such as hands per day, AI capabilities, and cosmetic or convenience items), not chips or a chance to win anything of value. Nothing on the Service is an offer of real-money gambling.

4. Your account

You're responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been compromised. We may suspend or close accounts that violate these Terms.

5. Your content

You may submit content such as player names, descriptions, personalities, catchphrases, strategy notes, and table chat ("Your Content"). You keep ownership of Your Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify, and use Your Content to operate, promote, and improve the Service, including displaying your players and their hands, chat, avatars, and scenes publicly on the Service.

You're responsible for Your Content. Don't submit content that:

• is unlawful, harassing, hateful, sexually explicit, or threatening;
• impersonates a real person, or uses someone else's name or likeness without permission;
• infringes anyone's intellectual property or other rights; or
• contains personal information about you or anyone else.

We may remove or edit any content, or retire any player, at our discretion.

6. AI-generated content

Players, table talk, avatars, voices, and scenes are generated in whole or in part by artificial intelligence. AI output can be inaccurate, unexpected, or unintentionally offensive, and it does not reflect our views. Nothing on the Service is poker, financial, or other professional advice. Win rates, bake-off results, and similar figures describe play-money simulations and are not a promise of any outcome.

7. Acceptable use

You agree not to:

• use bots, scripts, or scrapers to access the Service other than through features we provide;
• interfere with, overload, or attempt to gain unauthorized access to the Service or other accounts;
• reverse engineer the Service or attempt to extract our models, prompts, or source code;
• use the Service to build a competing product; or
• use the Service for any unlawful purpose.

8. Subscriptions and payments

Paid plans renew automatically at the end of each billing period until you cancel. Payments are processed by our payment provider, Stripe. You can cancel at any time from your account page, and you'll keep access through the end of the period you've paid for. All sales are final; see our Refund Policy. We may change prices or plan features with notice; price changes take effect at your next renewal.

9. Our intellectual property

The Service, including its software, design, branding, and the content we create, belongs to us and our licensors. These Terms don't give you any rights to it except the limited right to use the Service as intended.

10. Changes and availability

StakeHouse is an evolving product. We may add, change, or remove features, reset leaderboards or play-money balances, or suspend the Service at any time. We may update these Terms; if we make material changes we'll post the new version here with a new effective date, and continued use means you accept them.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including 5, 9, 12, 13, and 14) will survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVERY DAY BLACKJACK, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnity

You agree to indemnify and hold Every Day Blackjack, LLC harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content or your violation of these Terms.

15. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service.
